Board Attempts to Steal an Election

You may have heard by now that the election that was supposed to take place on Tuesday, January 25, 2022 was postponed. The Board may try to blame this on Covid or homeowners that don’t want to replace their balconies, but this is simply false.


The reason the election was postponed is because a judge ordered it. Below are some of the contents of the order:


THE COURT FURTHER ORDERS:

  1. That the Defendant, Naper Place Association dba Lisle Place Association is ENJOINED and RESTRAINED from holding or conducting the election for the Board of Directors, currently scheduled for January 25, 2022 at 7:00 p.m.

  2. The injunctive relief herein granted shall remain in effect until future Order of Court.

  3. Parties are to initiate expediated discovery in an effort to conclude the same within 39 days of this Order. (March 4, 2022).

  4. Parties are to appear for a preliminary injunction hearing on March 10, 2022 at 1:30 p.m. in courtroom 2007 without further notice.

  5. Parties may appear remotely at the March 10, 2022 hearing.

  6. Plaintiffs’ Emergency Motion for Temporary Restraining Order is GRANTED on January 25, 2022 at 12:00 p.m.

Eleven Lisle Place homeowners filed a lawsuit in court because the current Board tried to steal the election. You may have noticed that if you received a letter at all to be a potential candidate for the January 25th election, you received it at most two days before you had to return it in person to the clubhouse during the 5 business hours they were open on New Year’s Eve. Thus, the Board was able to run unopposed.


The judge saw through the Board’s attempt to steal the election by not allowing opponents and by not following their own bylaws or Illinois condo law in how to run an election. They even brazenly filed in court that “The Association has already held an election to determine the composition of the Board for 2022.” This was on January 24th!


There will be a new election that will have the eyes of the court on it. If there is any fraudulent or suspicious activity by the Board, we will again file in court and notify the judge. The new election will be free and fair.
